These Terms & Conditions ("Terms") govern your use of the onyxconsandconsult.com website and any construction, renovation, or consulting services provided by Onyx Construction and Consulting ("Onyx," "we," "us," or "our"), a construction and consulting business serving Houston, Texas and the surrounding areas. By using this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Onyx provides residential, commercial, and industrial construction, project management, and renovation/remodeling services. The specific scope of work, timeline, materials, and pricing for any project are set out in a separate written proposal, estimate, or contract signed by both parties. In the event of a conflict between these Terms and a signed project contract, the signed contract controls.
Estimates provided through this website, by phone, or in person are good-faith approximations based on the information available at the time and are not final until confirmed in a written proposal or contract. Final pricing may change due to site conditions discovered after work begins, material cost fluctuations, permitting requirements, or scope changes requested by the client.
Payment schedules (including deposits, progress payments, and final payment) will be set out in your project contract. Unless otherwise agreed in writing, invoices are due within the period stated on the invoice. Late payments may be subject to a reasonable late fee and may result in a pause of work until the account is brought current.
Onyx will obtain permits required for the scope of work we perform, in accordance with applicable City of Houston and Texas building codes, unless otherwise specified in your contract. Clients are responsible for providing accurate property information, HOA approvals (where applicable), and access to the job site. We are not responsible for delays caused by third-party permitting or inspection timelines outside of our control.
Onyx stands behind the quality of its workmanship. Specific warranty terms (including duration and coverage) for labor and materials will be provided in your project contract or applicable manufacturer warranty documentation. Normal wear and tear, damage from misuse, acts of God, or unauthorized modifications by others are not covered.
Any changes to the agreed scope of work, materials, or timeline must be documented in a written change order signed by both parties before the additional work begins, along with any associated cost or schedule adjustment.
